Introduction

Welcome to Live-Experts.com. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mobee Media Pty Ltd, operating the Live-Experts.com platform ("we," "us," or "our") regarding your access to and use of our platform and services. By registering for, accessing, or using Live-Experts.com, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

1. Service Description

Live-Experts.com operates as a digital platform providing access to AI-powered Expert Agents across various fields through live consultations, guidance, and interactive sessions. Our service utilizes artificial intelligence technology to facilitate real-time knowledge sharing and information delivery through automated expert systems.

2. Account Registration and Eligibility

You must be at least 18 years of age to create an account and use our services. By registering, you represent and warrant that you meet this age requirement. You agree to provide accurate, current, and complete information during registration and to maintain and update this information. You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breach.

3. Trial Period

New users are eligible for a one-day trial for a $1 sign-up fee. The trial begins immediately upon registration and includes full access to all platform features. If you do not cancel before the trial ends, your subscription will automatically convert to a monthly plan.

4. Monthly Subscription

After the trial period ends, your subscription automatically converts to $20.00 per month. Your payment method will be charged on the same day each month as your original subscription date. The monthly fee provides unlimited access to our AI-powered expert consultation services.

5. Automatic Renewal

Your subscription will automatically renew each month unless cancelled. You authorize us to charge your payment method for the monthly subscription fee. Renewal charges are processed on your monthly billing date. You can cancel your subscription at any time before the next billing cycle.

6. Payment Methods

We accept major credit cards and debit cards through our secure payment processor, Stripe. You agree to provide accurate and complete payment information. You must update your payment information if it changes or expires. Failed payments may result in service interruption.

7. Cancellation Policy

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods. After cancellation, you will continue to have access until the end of the paid period.

8. Refund Policy

Trial period charges ($1) are non-refundable. Monthly subscription fees are non-refundable once charged. If you cancel within the trial period, you will not be charged the monthly fee. Refunds may be granted at our sole discretion for service issues.

9. Price Changes

We reserve the right to modify subscription pricing at any time. You will receive at least 30 days advance notice of any price changes. Price changes will take effect on your next billing cycle after the notice period. You may cancel your subscription if you do not agree to the new pricing.

10. Service Credits

Active subscribers receive 500 credits per billing period. Credits are used to access AI expert consultations and services. Unused credits do not roll over to the next billing period. Credits expire when your subscription ends.

11. Taxes

All fees are exclusive of applicable taxes. You are responsible for any sales, use, GST, VAT, or other taxes. Taxes will be calculated and added to your invoice where applicable. Tax rates are based on your billing address.

12. Billing Disputes

If you believe you have been incorrectly charged, contact us within 30 days of the charge. We will investigate all billing disputes promptly. Undisputed charges must be paid in full. Fraudulent dispute claims may result in account termination.

13. Payment Authorization

By providing payment information, you authorize us to charge your payment method for all applicable fees. This authorization remains valid until you cancel your subscription. You agree to pay all charges incurred under your account.

14. User Conduct and Responsibilities

You agree to use Live-Experts.com in a lawful and respectful manner. You must not:

• Violate any applicable local, state, national, or international laws
• Infringe upon intellectual property rights of others
• Transmit harmful, threatening, abusive, harassing, or defamatory content
• Impersonate any person or entity
• Interfere with or disrupt the platform's operation
• Attempt unauthorized access to our systems
• Use the AI Expert Agents to generate harmful, illegal, or unethical content
• Attempt to manipulate, jailbreak, or circumvent AI system safeguards
• Use the service for any unlawful or fraudulent purpose

15. AI Expert Agent Services Disclaimer

Live-Experts.com provides access to AI-powered Expert Agents. These are automated systems powered by artificial intelligence technology and are not human professionals. All interactions are with AI systems, not licensed human experts. Interactions with AI Expert Agents do not create any formal professional-client relationship (such as attorney-client, doctor-patient, or accountant-client). While our AI Expert Agents are designed to provide helpful information, AI technology has inherent limitations. We make no warranties regarding the completeness, reliability, accuracy, or currentness of any information provided by AI Expert Agents. AI systems may occasionally produce inaccurate, incomplete, or inappropriate responses. AI Expert Agent consultations are not a substitute for professional advice from licensed practitioners. For legal, medical, financial, or other professional matters, you must consult with qualified human professionals. You acknowledge that you use information from AI Expert Agents at your own discretion and risk.

16. Intellectual Property Rights

All content, features, functionality, trademarks, logos, and materials on Live-Experts.com are owned by us or our licensors and are protected by Australian and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use our platform for personal, non-commercial purposes in accordance with these Terms. By submitting content to our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for operating and improving our services.

17. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our data practices as described in the Privacy Policy. You acknowledge that interactions with AI Expert Agents may be analyzed to improve our AI systems, subject to our Privacy Policy.

18. Limitation of Liability

Live-Experts.com is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by Australian law, our total liability for any claims arising from your use of our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law or other applicable consumer protection legislation that cannot be excluded, restricted, or modified by agreement.

19. Indemnification

You agree to indemnify, defend, and hold harmless Live-Experts.com, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

20. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through email notification or prominent platform notice at least 14 days before taking effect. Your continued use of Live-Experts.com after changes become effective constitutes acceptance of the modified Terms.

21. Termination

You may terminate your account at any time by following the cancellation procedure. We reserve the right to suspend or terminate your access to our services immediately, without prior notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

22. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. Before initiating any formal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation for at least 30 days.

23. Australian Consumer Rights Notice

Under the Australian Consumer Law, consumers have certain rights that cannot be excluded, including guarantees relating to acceptable quality, fitness for purpose, and correspondence with description. These Terms do not limit or exclude any rights you may have under the Australian Consumer Law or other mandatory consumer protection laws.
